The arrest of Wisconsin Judge Hannah Dugan over allegedly obstructing the apprehension of an undocumented immigrant is an attempt to intimidate the judiciary. You can just ask Attorney General Pam Bondi.
What has happened to our judiciary is beyond me, Bondi told Fox News, commenting on Dugans arrest. Theyre deranged. I think some of these judges think they are beyond and above the law, and they are not. We are sending a very strong message today: If you are harboring a fugitive, we dont care who you are. If you are helping hide one, if you are giving a [gang] member guns, anyone who is illegally in this country, we will come after you, and we will prosecute you. We will find you.
Bondi might have easily stuck to the specifics of Dugans case, insisting that her behavior was particularly egregious, and that Dugans indictment was about her individual conduct and not the judiciary as a whole. Indeed, in 2019, thats precisely what the Donald Trumpappointed U.S. attorney Andrew Lelling did in a similar case, when a Massachusetts judge, Shelley Joseph, was indicted for allegedly helping an undocumented immigrant escape. But Bondi chose to do the opposite, implying that Dugans indictment was an attempt to intimidate the judiciary itself. The message is that judges who anger the administration will be prosecuted at Trumps whim.
The courts have a role in our constitutional system that they can only preserve if theres an independent judiciarythat is to say, judges are free to make decisions without intimidation, without interference from the executive branch or the legislative, for that matter, Geraldine Hines, a retired Massachusetts Supreme Court justice, told me. This kind of prosecution is, in my view, and in the view of many of us who no longer sit on the bench, an effort to intimidate judges from playing their part in the constitutional order.

(742 posts)Except it doesn't work like that at all. And you are also assuming that 1) All governors would do this, (most wouldn't) and some state police have already been involved with ICE warrants as it is.
If a Federal criminal warrant is being executed, you can be assured that no state police are going to get in a shoot 'em up with the feds over something they may even agree with.

(742 posts)From what I understand, there was a deportation order in effect on this guy for over ten years which had nothing to do with his current charges.
No sane state official is going to buck the feds on something like this.

Do you think federal agents are going to draw on a state police detail i stead of just coordinating with them on a surrender IF a legitimate warrant is issued?
I doubt it. But a detail will prevent shenanigans like arresting a judge on some BS to intimidate the judiciary.

(742 posts)The judge was arrested on a federal warrant for disruption of an official proceeding or "obstruction"...There could have been 500 state police or county deputies present and nothing was going to stop her arrest on federal charges. They simply don't have jurisdiction over a federal complaint.

I really thought it would take a little more than that to buy off a state's Attorney General. Her fealty is now being rewarded, though.
