Judge bars Phoenix from enforcing parks ordinance against church group

A federal judge ruled that a Phoenix church group fighting a controversial new city ordinance limiting aid to homeless people in parks will be allowed to continue to serve food to homeless people in a city park without a permit — for now.

On Wednesday, U.S. District Court Judge Krissa M. Lanham granted an emergency temporary restraining order prohibiting the city of Phoenix from enforcing its ordinance, which bars food distribution for charitable purposes in city parks without a permit, against Orthodox Christian ministry St Herman’s Table and its founder and minister, Lance Brace. The judge found that Brace and his church, both plaintiffs in a lawsuit filed earlier this month, had valid claims that the new ordinance violated their First Amendment rights to the free practice of religion.

“Based on the present record and arguments, plaintiffs have established they are likely to succeed on their First Amendment Free Exercise claim,” Lanham wrote in her decision.

The order went into effect on June 10 and will expire on June 24, though Lanham will now consider whether to impose a preliminary injunction. The restraining order applies only to St. Herman’s Table and Brace, not other groups that feed and provide medical treatment to Phoenix’s homeless population.

if I see a homeless person asking for help, I'll stop and offer them a bottle of cold water I keep in an ice chest in the back of my SUV just for such purposes and a $10 bill so they can get something to eat and if they have a dog with them, I'll give an extra 10 for food for the dog.

This "ordinance" was nothing more than an attempt to deny our homeless pop. from receiving help from our local entities trying to help them and get them to leave our parks, which is nothing more than cruel and unjust.

So if I field the question, 'What would Jesus do?', he told us.

When asked what the greatest commandment was, the first thing out of his mouth was LOVE. He said love God, love your neighbor as you love yourself. Later he said treat others the way we wish to be treated, and then he elaborated on this even more in the dialog where he said, "For if ye have done it unto the least of these my brethren, ye have done it unto me."

That flies in the face of EVERYTHING Trump is doing, from the irresponsible tax cuts for billionaires and corporations, to the resulting massive cuts to programs that actually help Americans at their kitchen tables, the war in Iran, the Epstein files, deregulation, gutting the federal government, gutting the Voting Rights Act so Jim Crow 2.0 can happen across the South.

It will take decades to recover from the damage these people have done, and they must be held accountable. We do NOT want to hear lip noises about 'looking forward' when we finally take back power. We need accountability. Indictments. Trials. Convictions.

I think the people behind the beltway in DC - even the sane ones - are not aware of the white-hot rage building among Americans. I am seeing 1789 and guillotine memes. I am seeing short videos by young people lamenting how they can't even pay their bills even though the work really hard.

My mortgage has gone up $110 due to increased escrow requirements because of both property insurance and taxes. It is costing more to drive, groceries have gone up out of this world, my power bill is up, my water bill is up, I have healthcare debt and I'm getting nickel and dimed every which way but loose.

Last year I paid in ~$18K to the federal government in taxes and I'm getting NOTHING in return. I would suggest the last time Congress did anything that materially benefitted me and my family on a permanent basis was FMLA back in the Clinton era. Before that it was the passage of Medicare in 1965. I was 7.

Instead, Congress has gone the focus group and slick PR route because they stopped worrying about what the people actually want back in the 1990s. The big donors are happy, so we have congresspeople pounding their chests and talking about their bipartisan bills, but nothing at my kitchen table ever seems to change. Our national government has become so corrupt it cannot even function, and that is by careful design. The people in power now genuinely believe the only thing our government should be doing is war (formerly 'defense'). They want to gut the New Deal, privatize everything in sight including Social Security and Medicare, and in the meantime Trump unleased Elon and 64 billionaire robber barons on the treasury and they are busy stripping it of everything they can steal and leaving us flapping in the wind.

If we do not want a revolution, then when we take power, we must hold these people accountable while at the same time looking forward.
