This case will never make it to a jury. I am surprised that Piro got a grand jury to go along with this indictment
A former Justice Department prosecutor laughed Thursday at the government's Reflecting Pool case against a former Olympian, calling the key evidence "worthless.

"To do that beyond a reasonable doubt, that may be hard if all you have allegedly is him reaching into the water and touching a detached piece of blue paint from the bottom of the pool," Rossi said on LiveNOW from Fox.
"If that's their case, they may have a tough, tough hurdle before a jury.".....
"I'd rather be the defense attorney in this case than the prosecution," Rossi added, "unless the prosecution has some great eyewitnesses, great law enforcement officials testifying, or maybe a video."
The case plays out against President Donald Trump's claim that vandals wrecked the $14 million-plus pool. Trump wrote on Truth Social that a "350 foot gash, made by a very sharp knife or razors" was cut into the liner.
"Are you going to believe me or your lying eyes?" Rossi asked, invoking Groucho Marx. "The American public, when they saw the Reflecting Pool after it was allegedly renovated in the middle of June the next couple of days, there was algae, it turned green. Your eyes are telling you that something is not right with the way they did this."

(1,521 posts)the defense attorney is gonna ask for the grand jury transcripts. and he will get them.
What do grand jury transcripts have to do with case making it to the jury?

(27,589 posts)Its a tough hill to climb to get grand jury transcripts and to get and to get a dismissal based on the transcripts.
Not sure what was the trigger in causing the release of the Broadview Six case but the defense has to make a strong showing upfront there were shenanigans afoot. The defense cant just go on a fishing expedition.
Everyone knows these trump clowns are playing fast and loose with the rules when they think they are protected by the grand jury secrecy veil. The trick is lifting that veil.
So far, the SPLC has been denied transcripts by a magistrate judge. 100% the prosecution played games to get that indictment. Not sure if they will get any help from the appeals court in Alabamas even though that indictment was and is a complete joke.
Don Lemon and the other reporter(s) have been denied by a magistrate but have an appeal pending.

(1,521 posts)What they gave her was heavily redacted. Then the prosecutors offered to drop the entire case. That is when the judge asked to see the entire transcript without the redactions and found out that the prosecutor had "vouched" for the evidence and that Boutros actually came to the grand jury and gave the jury a "talk". Both completely illegal

(1,521 posts)IMO the grand jury transcripts will show that there was misconduct. Just like in a dozen other cases mainly in Chicago. The DOJ has lost it's presumption of regularity in the courts. That is why the defense will get the transcripts.
