'Illegal campaign activity': GOP senator prompts Trump admin to investigate Jack Smith

Former Department of Justice (DOJ) special counsel Jack Smith is now under investigation by President Donald Trump's administration, following a complaint filed by a Republican member of the U.S. Senate. The New York Post reported Friday that the Office of Special Counsel (OSC) an independent agency not to be confused with Smith's former role at the DOJ had launched a Hatch Act investigation into Smith, after Sen. Tom Cotton (R-Ark.) alleged Smith's investigation into Trump was politically driven (the Hatch Act prohibits federal employees from engaging in political activity while on the job).
"Jack Smiths actions were clearly driven to hurt President Trumps election, and Smith should be held fully accountable," Cotton told the Post. "Jack Smiths legal actions were nothing more than a tool for the Biden and Harris campaigns. This isnt just unethical, it is very likely illegal campaign activity from a public office," the Arkansas Republican wrote in his letter to OSC. "Many of Smiths legal actions seem to have no rationale except for an attempt to affect the 2024 election results actions that would violate federal law." "These actions were not standard, necessary, or justified, Cotton added. They were the actions of a political actor masquerading as a public official.
Smith was tapped by then-Attorney General Merrick Garland to head two criminal probes into Trump one for his role in the January 6, 2021 siege of the U.S. Capitol, and another for allegedly mishandling troves of classified documents at his Mar-a-Lago residence in Florida. Trump faced four felony charges in the January 6 investigation, and 37 felony charges in the classified documents case.
The trial in the January 6 case was delayed until after the 2024 election after Trump successfully appealed his ability to stand trial as president to the Supreme Court. That prompted the Court's conservative majority to issue its landmark July 1, 2024 ruling in the Trump v. United States case giving presidents absolute broad immunity from criminal prosecution for anything deemed an "official act."

Cottons action is that of a political actor masquerading as a public official. Cotton is a Federal Employee and Hatch Act prohibits federal employees from engaging in political activity while on the job
So, yes, remove him from office.

Eventually, they will be exposed for their lies and guilt, but they know it takes time for that to happen, so by then, they have moved on to the next "projection".

(158,623 posts)He WAS "arrested" and charged. It was posted all over DU. It might not have looked like the "Law and Order" teevee fantasy "perp walk" but he was in fact, "arrested" 4 times for criminal charges. Twice by the feds and twice by states (GA & NY).

Yes that was an "arrest mug shot", which establishes that yes, he was "arrested" (despite him now using that image to make money off of).

Trump and his allies have not presented specific evidence of wrongdoing.
The OSC is different from the type of special counsels office formerly headed by Smith, who was appointed by the Department of Justice. The independent agency lacks the authority to bring criminal charges and prosecute individuals who violate the Hatch Act, but it may seek disciplinary action for a federal government employee, such as removal from the civil workforce, or refer its findings of Hatch Act violations to the DOJ for investigation.
On Wednesday, Sen. Tom Cotton, R-Ark., requested that the OSC investigate Smith for unprecedented interference in the 2024 election. A source familiar with the matter says the OSC affirmed to Cotton that it is proceeding with its inquiry following his request.....
Trumps nominee to head the OSC is stalled in the Senate. A White House official told NBC News that Paul Ingrassia, a former podcast host with a history of incendiary commentary, is meeting with senators in one-on-one meetings over the next month before a confirmation vote takes place.

While it could refer its findings to DOJ, the department has already publicly said that it is investigating Smith and other prosecutors who pursued Trump through its so-called "Weaponization Working Group" that is being led by former interim DC U.S. attorney Ed Martin.
The announcement of the investigation also comes as the administration has found itself under increased scrutiny over its handling of the release of filings relating to deceased sex offender Jeffrey Epstein with top officials from across the administration appearing eager to change the subject.

(60,478 posts)First of all, more than ANY administration in my lifetime, practically everyone in the first Trump administration BLATANTLY violated the Hatch Act.
The Hatch Act says people working for the President can not do political election stuff. Now both of Obama's Secretaries of State, though both prominent people politically, did not attend the convention when they were secretaries. In 2020, SoS Pompeo appeared remotely at the convention from Jerusalem. Clear violation of the Hatch Act. While Obama Hud Secretary Castro was called out for appearing at a political event, none of the repeated, far more obvious Trump violations were ever acted on.
Now, if you look up the Hatch Act, the penalties are pretty weak.

I remember having to take annual training on it and it was to the point where back when Obama was first elected, we were not allowed to have pics of say, Michelle and their girls, in our offices or cubicles - ONLY the "official" portrait of Barack Obama.
The idea that a prosecutor was brought in to supervise 2 federal criminal cases under the auspices of the Attorney General, against a defendant who happened to be a FORMER President (who hadn't even "officially declared" his candidacy for 2024 when said prosecutor was brought in), is the epitome of absurd.
All of this is throwing everything (including the kitchen sink) around the room in order to distract from the Epstein mess.
