US Air Force to deny retirement pay to transgender service members being separated from the service

WASHINGTON (AP) The U.S. Air Force said Thursday it would deny all transgender service members who have served between 15 and 18 years the option to retire early and would instead separate them without retirement benefits.
The move means that transgender service members will now be faced with the choice of either taking a lump-sum separation payment offered to junior troops or be removed from the service.
An Air Force spokesperson told The Associated Press that although service members with 15 to 18 years of honorable service were permitted to apply for an exception to policy, none of the exceptions to policy were approved. About a dozen service members had been prematurely notified that they would be able to retire before that decision was reversed, according to the spokesperson who spoke on condition of anonymity to discuss internal Air Force policy.
All transgender members of the Air Force are being separated from the service under the Trump administrations policies.

(789 posts)If a person serves honorably then they should be able to retire just like everyone else and not because of their gender identity. This reminds me of the 1970s when gays wanted to serve openly in the military. Eventually, the were accepted and while some personnel didn't like it gays had the same opportunities that others had. I knew people who were openly gay in the 1970s and 80s and they did their jobs just like everyone else did.
Transgender people were accepted by the AF to serve and they signed an enlistment contract committing to serve. As long as they performed their duties and were held to the standards everyone else was held to then there's not reason, other that bigotry, for them to continuing to serve.
I hope those that are being discharges and/or denied retirement sue the AF and the federal government for discrimination and breach of contract.

My dad flew combat in three wars and didn't care who the hell had his back.
Someone saving his life and the rest of the crew was A-1 to him.
I am glad he is not alive to see this crap.

(6,405 posts)My father's words to me, when I told him I was going to enlist in the military were "Enlist in the Air Force. They take care of their own." (He had been an Army Medic in WWII).
Today, the Air Force is going back on its promise to those who offered their all for this country. Shame on them, and shame on the U.S. for allowing this to happen.
I will never recommend public service of any kind (civilian or military) to anyone until this country is back on the right track and looks like it's going to stay that course. Until then, it's a losing proposition all around... for the individual who asks if it's worth it, and for the country that's no longer deserving of it. IMO... YMMV (but right now, I'm very opinionated about it!)

(308 posts)Along with the typical "transgenderism is mental illness" rhetoric I'm reading assertions that trans service members have been serving "under false pretenses" in order to have their "illness" legitimized by the military and have thus disgraced themselves AND the service. They further assert that this move is returning honor to the branch.
...as if volunteering to serve and potentially die for one's country isn't honorable.
The downward spiral is just so damned depressing.

(12,663 posts)The minor thing: The Equal Protection Clause in the Fourteenth Amendment. The Due Process clause of the Fifth Amendment might have some application if the courts can be convinced these folks have a property interest in retirements benefits which have not yet accrued.
The big thing: I am concerned that the current SCOTUS will stand by precedent that gender identification is a suspect class.

18 years or more is kind of a safe harbor - very, very hard to put anyone out after 18 years except for misconduct.

I question that a service member can be fired based on gender identification but it will take court action to answer that question. I have very little (disappearingly little) confidence in the current SCOTUS on this issue.

As the surviving spouse of a Retired Military person, I am appalled at how the LGBTQ+ community who have served with dignity and grace for a country and an Administration that does not want them to even exist. To deny them Veteran's benefits and services that they rightfully earned is a stain and disgrace.
The last lines of the National Anthem states "The Land of the Free, and the Home of the Brave" will have lost its meaning. My husband is perhaps as riled in death at this move by the very branch of service he served in his early adult years and later on for 18 additional years, with the MN Army and Air National Guard; as I am in this life and country I used to be proud of.

They apparently were in fact offered early retirement only to be rescinded now. Just my opinion, but I don't see a valid legal basis for this so I think a potential lawsuit is a very strong one.

Now that plan has changed.
Members of the Air Force who were told they could get the retirement benefits they earned are now being told they have choice but to quit or be kicked out without their benefits.
A memo obtained by Reuters, written by the acting assistant attorney of the Air Force Brian Scarlett, reads After careful consideration of the individual applications, I am disapproving all Temporary Early Retirement Authority (TERA) exception to policy requests in Tabs 1 and 2 for members with 15-18 years of service.
This is the complete opposite of what the Pentagon promised when Trumps ordered that trans people be removed from military.
Straight up illegal discrimination.

The best challenge to this outrage is to attack the separation. Trump issued a regulatory change making gender dysphoria service disqualifying. I have serious doubts whether this is consistent with statute or the Constitution.
