DOJ Tried To Get Names And Social Security Numbers Of Trans Kids

The Justice Department has demanded that a Philadelphia hospital hand over a broad swath of information related to gender-affirming care for minors, including individual patient names, dates of birth and Social Security numbers, according to a copy of a subpoena that became public in a court filing Monday.
The DOJ issued a subpoena to the Childrens Hospital of Philadelphia in June. It requested doctors emails, texts, social media and Zoom recordings dating to January 2020, long before any state legislature in the United States had passed a ban on gender-affirming care for transgender youth, The Washington Post first reported. The subpoena was made public this week in a court filing by the Washington state attorney generals office.
Washington State Attorney General Nicholas W. Brown sued the Trump administration in January to block two executive orders that tried to withhold federal funding from institutions that offered gender-affirming care. Brown wrote in court documents that he included the subpoena to the Childrens Hospital of Philadelphia because President Donald Trump has only escalated his attacks since a federal judge initially blocked Trumps efforts to curb youth gender care in March.
Last month, Attorney General Pam Bondi announced that the Justice Department had issued more than 20 subpoenas to doctors and clinics that it said mutilated children in the service of a warped ideology. It was not clear at the time what information the government was seeking from these health care providers. DOJ did not immediately respond to a request for comment.

(158,835 posts)particularly about the subpoena to CHOP (Children's Hospital of Philadelphia, which is the oldest of its kind in the U.S. and one of the largest in the world - I remember being in there as a young child, decades before they started all the new lo-rise and towers construction ). There are building yet another tower for it (they have a HUGE endowment) -

The Justice Department is demanding that hospitals turn over a wide range of sensitive information related to medical care for young transgender patients, including billing documents, communication with drug manufacturers and data such as patient dates of birth, Social Security numbers, and addresses, according to a copy of a subpoena made public in a court filing this week.
The June subpoena to Childrens Hospital of Philadelphia requests emails, Zoom recordings, every writing or record of whatever type doctors have made, voicemails and text messages on encrypted platforms dating to January 2020 before hormone therapy, puberty blockers, and gender transition surgery had been banned anywhere in the United States. About half of states have since passed laws prohibiting all or most gender treatment of minors. The Supreme Court ruled in June that a Tennessee ban did not violate the Constitution.
Attorney General Pam Bondi said last month that the Justice Department had issued more than 20 subpoenas seeking to hold medical professionals and organizations that mutilated children in the service of a warped ideology accountable. It is highly unusual for the nations chief law enforcement officer to announce such legal activity. Bondi did not identify who received the subpoenas, what information the government sought, or what potential law violations it is investigating.
In legal filings, CHOP has challenged the Trump administrations right to the information sought in the subpoena, stressing the privacy concerns of a uniquely vulnerable population. CHOP said disclosing exceedingly sensitive and intimate, personal details about the lives and struggles of these patients would be very damaging to their mental health and could even result in thoughts of, or completed, suicide.

and pay out the nose in lawsuits.
Hospitals will get hit hard too.

(158,835 posts)nor is there any federal law against it. An E.O. isn't "law" and is merely supposed to direct how agencies interpret existing law, but it is being misused as being some kind of "law".

This is like in submarine movies, where if you have codebooks, you need to burn them. Parents should be given a copy of their kids' charts and then the databases should be deleted.
Or, you know, fall prey to malware. That could have been what happened, too.

(158,835 posts)and 45 has lost a bunch regarding cutting off funding and in many cases, 45 finally complied. The "losses" that 45 has racked up are rarely featured in the M$M.
I try to dig daily through dozens of news sites to find the stories of the suits being filed (along with appeals) and the results.

(1,759 posts)I know some of the people involved - former coworkers, conference friends -- and the thing is, those lawsuits will take a long time. The SC has already shown it is unwilling to prioritize science, or even that convenient-when-they-feel-like-it "parents rights" excuse. Hospitals, with few exceptions, are closing down not only minor care, but in some places, adult trans care too.
Everybody knows where this is going. Hospitals and doctors can't wait out until they win a suit - and then they'll have to get moneys released, usually needing to sue, again.
This is the same tactic that the trumpists use elsewhere: if they can apply quasi-legal power, they do, and if not, they cut off money and drag things out in the courts.
In rare situations, legal victories happen, for instance a case against a medical provider being dismissed because the health care org was a federally qualified health care ctr, so the med pro was a federal employee and thus couldn't be sued by the plaintiff. We'll see what happens next, frankly -- as the organization sees no minors, there might be a grace period, at least until Trump (and the American Principles Project, et al) figure out how to end trans medical care altogether.

(158,835 posts)and I know since I have been on DU, there has always been joking about "Agent Mike", although with this administration, we are probably closest to having that become a reality. One can only hope that the SCOTUS still upholds the very first Amendment to the Constitution. But the one thing that is not tolerated (even for the 1st Amendment) is physical "threats" and that is something to avoid.

(158,835 posts)(and this is a separate issue that has been contested mightily itself), many hospitals nowadays are run by private equities. It's rare to find an "indie" hospital that is not already under a University medical system or is not owned/run by a private equity firm.
So there is a different dynamic. Plus HiPAA hasn't suddenly gone away after almost 30 years of being in existence and the SCOTUS hasn't suddenly discarded it yet (like they have discarded other things).
