Trump Calls for Democrats Who Urged Soldiers to Disobey Illegal Orders to Be 'ARRESTED AND PUT ON TRIAL'

President Donald Trump called for six Democratic lawmakers who put out a video urging military members to “refuse illegal orders” to be “ARRESTED AND PUT ON TRIAL” in a stunning Thursday morning Truth Social post. The video, which was shared by Senator Elissa Slotkin (D-MI), featured appearances from herself, Senator Mark Kelly (D-AZ), as well as Reps. Jason Crow (D-CO), Chris Deluzio (D-PA), Chrissy Houlahan (D-PA), and Maggie Goodlander (D-NH).

“We want to speak directly to members of the Military and the Intelligence Community. The American people need you to stand up for our laws and our Constitution. Don’t give up the ship.” wrote Slotkin in her caption. As a group, the Democrats submitted that “This administration is pitting our uniformed military and intelligence community professionals against American citizens.” “Right now, the threats to our constitution aren’t just coming from abroad, but from right here at home. Our laws are clear: You can refuse illegal orders. You can refuse illegal orders. You must refuse illegal orders,” they continued, before going on to assert that “We have your back.”

“Don’t give up the ship,” urged several of the participants at the conclusion of the video. On Thursday morning, Trump shared an article about the video, as well as his own thoughts on the matter. “It’s called SEDITIOUS BEHAVIOR AT THE HIGHEST LEVEL. Each one of these traitors to our Country should be ARRESTED AND PUT ON TRIAL. Their words cannot be allowed to stand – We won’t have a Country anymore!!! An example MUST BE SET. President DJT,” he wrote.

That opening volley was followed up by a number of reposts of comments assailing the Democrats in the video — including one which called for them to be hanged — as well as a second post from Trump himself. “This is really bad, and Dangerous to our Country,” argued the president. “Their words cannot be allowed to stand. SEDITIOUS BEHAVIOR FROM TRAITORS!!! LOCK THEM UP??? President DJT”

I used to teach a class at LMET about this specific subject. I will reiterate to ALL active duty, reserve and National Guard troops that they have an obligation to refuse illegal orders, whether they come from the CinC, or the Senior Deck Seaman in 2ND Division.

...perfectly legal act by design. That was a clear abuse of power that the Founding Fathers sought to end.

In America today, seditious conspiracy is the legal standard. It requires two or more people, and must involve plans to:
Levy war against the U.S.
Oppose the government by force
Prevent, hinder, or delay the execution of any U.S. law by force
Seize or take government property by force

Do any of those things occur in the video? Are they in any way suggested even?

Mango Mussolini and Pee Wee German seem to fit the description much better than those merely pointing out what the actual law IS.

And, go back and read those in the context of January 6th and then explain to me why...oh never mind....

In theory, the Democratic video shouldn’t have been especially controversial. In practice, Team Trump’s pushback has been over the top.

Dem veterans reminded servicemembers to refuse illegal orders.

In practice, the partisan pushback has been ferocious.....

On Thursday morning, the president published an item to his social media platform responding to the message from the Democratic veterans, saying, “This is really bad, and Dangerous to our Country. Their words cannot be allowed to stand. SEDITIOUS BEHAVIOR FROM TRAITORS!!! LOCK THEM UP???”

This dovetailed with a similar message, also posted on Thursday morning, which read, “It’s called SEDITIOUS BEHAVIOR AT THE HIGHEST LEVEL. Each one of these traitors to our Country should be ARRESTED AND PUT ON TRIAL. Their words cannot be allowed to stand — We won’t have a Country anymore!!! An example MUST BE SET.”

Soon after, the Republican added, “SEDITIOUS BEHAVIOR, punishable by DEATH!”

Trump similarly amplified an online message written by someone else, who wrote, “HANG THEM GEORGE WASHINGTON WOULD !!.....

In the recent past, many leading GOP voices warned that rhetoric like this was corrosive to society and heightened the risk of political violence. Evidently, the incumbent president, outraged by calls in support of the rule of law, doesn’t care.

Under U.S. military law and international law, only lawful orders create a duty of obedience. The UCMJ (Arts. 90–92) makes clear that obedience is required only for lawful commands. In U.S. v. Calley (My Lai), the court rejected “following orders” as a defense to obviously criminal conduct against civilians. The Nuremberg Principles go further, establishing that individuals have an affirmative duty to refuse unlawful orders and remain personally responsible for war crimes despite superior direction.

Legal Authority
Core Principle UCMJ Articles 90, 91, 92 Service members must obey lawful orders; there is no duty to obey unlawful orders.
United States v. Calley (My Lai) “I was just following orders” is not a defense to manifestly illegal acts such as murdering civilians.
Nuremberg Principles (Post–WWII) Individuals have a duty to refuse unlawful commands; superior orders do not erase personal responsibility for war crimes.
