Divorce Rules Could Change for Millions of People Under Republican's Plan Published

A Republican candidate in Floridas gubernatorial race is proposing a major change to the states divorce laws.
James Fishback said this week he would support changing the laws so that anyone who cheats would lose full custody and full claims to any assets in that marriage.
What To Know
Fishback discussed his proposal during a recent campaign stop, and a livestream of the event was public on his campaigns Facebook page Friday morning.
Divorce, its a tragedy. Look, if youre an abusive relationship, I will always support your right to exit that relationship. But if you cheat on your partner, I'm going to reform the divorce laws so you give up 100 percent of everything, he said. No questions asked. If you are an adulterer in our state and then there is a divorce, you as the adulterer, you as the cheater, will lose full custody and will lose full claims to any assets in that marriage.
He said he has seen people who have suffered through the stress, the pain, the affliction of divorce and that growing up in a two-parent household is a privilege.

(54,664 posts)A second thought: There'll be a migration of married folks to other states to establish "residency" in order to start the divorce process.

(574 posts)This puritan view of divorce by Mr. Fishbrains would force people to remain in a cold, loveless relationship causing even more suffering, stress and pain. Some might go as far as suicide to get out, like they did prior to the no fault divorce.
I propose marriage licenses with a five year expiration date. At the end of five years, you either renew or you split assets 50-50 and move on.

Conversely, if you want to stay with someone, you will. You don't need marriage to be in a committed relationship.

(2,649 posts)This is what a lot of people can't understand. Saying something is "marriage-like" before it existed is rather disingenuous because marriage is a specific concept governing property, inheritance, and paternity. There is nothing "godly" or a "commitment" or sacred about it. It has been around only about 5,000 years. The human race existed just fine without it long before it came about.
It has always been the foundation of patriarchy, and that is why the religious right nutjobs like the Heritage Foundation and the Christian "reconstructionists" (misnamed nationalists) want to prop it up so much. They know what it is and what it entails, which is the subjugation of women.

(48,960 posts)but all the assets generated while they were married? Yeah, I dont see that going very far. Unless, of course, Mr. Fishback has envisioned a way it would only target women.
