Hospital settles lawsuit with woman raped at facility by nurse's aid

AUGUSTA -- A settlement was reached on the eve of trial in the civil lawsuit filed by a woman against the hospital where she was raped by a nursing assistant.

The civil case against Select Specialty Hospital was settled for undisclosed terms on Friday. The Richmond County State Court case was set for trial Monday.

The case had been pending since 2012. It nearly ended before a ruling by the Georgia Court of Appeals revived the case with a ruling that a jury should decide the credibility of other reports of sexual assault on patients between 2004 and 2008.

On July 13, 2009, Warren Butler sexually assaulted a 57-year-old patient at Select, a transitional facility for patients who need long-term medical care.
