Appellate court will hear Gloucester ballot design case

Appellate Court Judge Greta Gooden Brown will allow an emergent appeal from Gloucester County Republicans in their challenge to the illegal design of general election ballots for the November general election.

She set a deadline of 4 PM today for the Republicans to file their motion, with an opposition motion due at 4 PM tomorrow.

However, Gooden Brown denied a stay of the trial court’s ruling, which allows the ballots to remain for now.

Superior Court Judge Benjamin Telsey found that the county clerk, Democrat James Hogan, violated state law when he created the office block ballots for the general election. But Telsey determined that reprinting vote-by-mail ballots already out – and some cast – might confuse voters; he rejected the GOP request for new ballots.
