Justice Department changes course on international students days after first New Mexico lawsuit

A Ghanaian doctoral student at the New Mexico Institute of Mining and Technology who recently saw his F-1 student status terminated got good news in a federal court Friday. He received a temporary restraining order allowing him to retain his academic standing while a new lawsuit over his status is pending.

The small victory for the plaintiff, identified in only as “K.O.D.” in court documents, came as the U.S. Department of Justice announced in a federal court in Washington it would restore the student visa registrations of more than 1,000 international students following legal pushback from hundreds of them.

Legal action forced the federal government to retreat on actions against international students. Facing dozens of lawsuits, the Justice Department announced it would restore SEVIS registrations for over 1,000 students — but only for those whose visas hadn’t been revoked.
