It's because ALL human fetuses are FEMALE at conception. The Y chromosome doesn't manifest itself until later in the gestation period, and that change, like every other change a fetus undergoes, can happen on an infinitely variable timeline. This not only affects the body, it affects the brain as well. And – pay attention, Clarence – the brain is where an individual's sense of self develops. Bottom line: People are born gay and/or trans, every day. As an esteemed jurist, it is your responsibility to stay up to date regarding matters on which you will later pass judgement.
