Delaware just moved to write same-sex marriage into its state constitution, building a firewall around a right that suddenly feels a lot less permanent than it did a decade ago.
It almost didn't happen. The exact same measure failed one week ago. It came back Tuesday, the final day of the session and the last real shot for at least three years, and passed with 28 yes votes, the exact two-thirds it needed and not one to spare.
Three lawmakers who helped sink it last week reversed course, including a Republican who crossed over to join every Democrat. The measure would enshrine both same-sex and interracial marriage, protecting them no matter what happens in Washington.
With Justice Clarence Thomas openly pushing to revisit Obergefell, that federal guarantee no longer feels like one, and Delaware is one of a growing number of states deciding not to wait and find out.
"Just one week ago, we failed the people of Delaware," said sponsor Rep. Claire Snyder-Hall. "But today, the General Assembly affirmed that every Delawarean has the fundamental right to marry the person they love, regardless of race or gender."
