As Trump Militarizes the Streets of America, What Constitutes A Lawful vs. Unlawful Military Order? - Glenn Kirschner
In Donald Trump's first term, he said to his Secretary of Defense, Mark Esper, "Can't we just shoot protestors in the legs?" Secretary Esper said his impression was that it was a question AND a suggestion.
With the militarization of the streets of America, first in California, soon coming to Florida, and undoubtedly elsewhere, the following issue will soon come into full focus: what happens if and when Trump starts giving the military illegal orders.
In part 2 of this interview series, I discuss this topic with retired LTC and career Army JAG officer Geoffrey DeWeese. Geoff is the Legal Director of The Orders Project, which is part of the National Institute of Military Justice, and an expert in the area of lawful versus unlawful military orders, and the duty of military members to disobey patently unlawful military orders.
