Sure there have been, many times. One example: slavery was effectively abolished de facto before the Thirteenth Amendment was ratified.
More often than not, elections and legislation merely reflect social and political change that has already happened. The mysterious failure by so many Democrats to recognize that obvious truth is a big part of the reason why we struggle to defeat the right wing despite broad public support for very progressive policies.
"First we need to get the seats, then we can talk about (fill in the blank with various progressive causes)" has been a mantra with too many Democrats since Reagan. All sorts of compromises then ensue - "in order to win!" It is a formula for disaster and has led to the MAGA nightmare we are now living.
First take and stand and the seats (and the legislation and the judicial decisions) will follow.
