3. Haven't read article but I would bet this is the outcome of the Chevron SCOTUS case

That essentially stripped regulatory agencies of the power to set regulations unless they were explicitly spelled out in their founding (or subsequent) legislation by Congress. So AI is going through all regs and comparing against the original bill and saying 'nope, the agency decided this on its own - SLASH!'. It's what Bannon and others have decried as the 'administrative state', but of course it was Congresses intent for experts at the agencies they founded would use science and evidence to figure out the details and make appropriate rules.

Just another way the Trump SCOTUS fucked the USA.
