Unlawful sexual intercourse and rape are not the same thing even if the former is sometimes colloquially called statutory rape. The fact that it is unlawful to have sex with an underage person doesn't mean the underage child did not willingly engage in the act. The child's choice is just not an element of the the crime. The child retains his/her agency. It's just not a defense an adult can use to escape prosecution.
