that President Obama should appoint a Supreme Court justice (outside of a recess appointment, of course) is making the case for a wholly unconstitutional act. He simply can't do it.

And while the Republican obstructionism with regards to taking up the nomination is wrong, it is not unconstitutional. There is no time limit to which the Senate is held, after which a President can just say "screw it, I'm making the appointment".
