2. There seems to be some confusion (at least by me) about this

since an extension, that this is apparently referenced, was published in the Federal Register last month - https://www.federalregister.gov/documents/2021/08/03/2021-16481/designation-of-haiti-for-temporary-protected-status

The above extension had apparently been announced this past May - https://www.usnews.com/news/politics/articles/2021-05-22/us-again-extending-temporary-protected-status-for-haitians

I think it's because the various countries have staggered dates for extensions and some of the extensions were due to court cases.

This seems to summarize a little of what is going on -

DHS Extends TPS Status and Documentation Validity for Several Countries United States

At a glance

  • The Department of Homeland Security will extend through December 31, 2022 the status and employment authorization documentation for TPS beneficiaries of El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan. The current expiration date for these groups is October 4, 2021.

  • TPS beneficiaries eligible for automatic EAD extensions to December 31, 2022 under the new announcement may complete or update their I-9 employment eligibility records by providing an employer with a copy of the Federal Register notice, an eligible expiring or expired TPS EAD, and any other required I-9 documents.

  • Haiti benefits from a subsequent, separate TPS designation announced in August 2021. The new Haiti designation extends through February 3, 2023, and all those eligible are encouraged to register, including those with Haitian TPS under the prior designation.


  • The issue

    The Department of Homeland Security (DHS) will continue to preserve Temporary Protected Status (TPS) designations for nationals of El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan given that the Ninth Circuit Court of Appeals has not yet issued a directive that would allow the federal government to move forward with the termination of TPS for these countries. According to a Federal Register notice to be published on September 10, 2021, TPS status and employment authorization documentation for beneficiaries from these countries will be extended through December 31, 2022. They had been set to expire on October 4, 2021.

    So I *think* there are ovelapping "extensions" related to Haiti where one automatically goes until 2022 and the new one goes to 2023 and those who want the latter, would need to apply for that now.

    So working through all that, I am "getting it" now.
