Four GOP lawmakers say they want to be the judges of Ohio's abortion laws [View all]

Unconstitutional and idiotic political stunt! And they complain about “government overreach”!

COLUMBUS, Ohio – Four House Republican lawmakers say they plan to introduce legislation that would cut out the courts and instead declare themselves the arbiters of when abortions are legal in Ohio.

Their news release is the latest in a string of signals that state lawmakers may try to undermine the newly minted state constitutional guarantee to abortion access in Ohio.

On Tuesday, voters passed Issue 1 on a roughly 57% to 43% split. The amendment, which takes effect on Dec. 7, grants every individual the right to carry out their own decisions on abortion, contraception, fertility treatment and miscarriage care. It blocks the state from passing laws limiting abortion access before the point of viability, roughly 22 weeks into a pregnancy. From there, laws could limit abortion except when it’s necessary to protect the health and life of the woman.

“We will withdraw jurisdiction from the courts so that they cannot misapply Issue 1 for the benefit of the abortion industry,” Gross said in a similar version of the release, published by the anti-abortion interest group Ohio Value Voters and later detailed by the Cincinnati Enquirer.

In interviews, three different constitutional lawyers said the proposal is likely unconstitutional and amounts to a political stunt.
