2. Three days is a pretty high bar to force states to get their data into the federal system.

1.4bn isn't enough, and that 1.4bn isn't as accessible as you might think. It's paid out as states achieve certain milestones, like a reward for compliance. On the flipside, there's no stick to counterbalance that carrot if they fail compliance. That means the state has to front the money to update and participate, and may get a rebate/reward for doing so.
