Donald Trump has had his Department of Justice bring vindictive prosecutions against his enemies: former FBI Director James Comey and New York Attorney General Letitia James. Recent reporting suggests that DOJ also is on the verge of indicting another Trump enemy, former National Security Advisor John Bolton.
All three Trump enemies will have a vindictive prosecution claim. But not all vindictive prosecution defenses are created equal.
