(11,209 posts)37. Prior to 1968 police encounters fell into two categories: consensual conversation or arrest.
The Court created the concept of detention in Terry v. Ohio, 392 U.S. 1 (1968). In an 8-1 decision (Douglas, J., dissenting) the Court allowed police to briefly detain people to investigate if the police have reasonable articulable suspicion that they have committed, are committing, or will commit a crime. The suspicion must be based on specific objective facts.
