He refused.

Costa Rica offered him asylum.

I don't know what the penalties for smuggling would be.

Even if he is found not guilty, they will likely deport him to a third country after his trial since there is an active deportation order on him from 2019. The 2019 order prohibits deporting him to El Salvador, but not a third country.

I think alot of Trump's actions against him are due to embarrassment. For some reason Fox News is demonizing this guy, which indicates that Trump is feeding them a narrative.
