(45,577 posts)If four -- or more -- vote to grant cert, then cert is granted and the case is scheduled for briefing and oral argument later in the court session. Generally, when cert is granted or denied, how many of the justices were for or against granting cert is not disclosed. However, on occasion, one or more justices may publish a written dissent to either the grant or the denial of cert.
The outcome of Maxwell's petition will not be known until after the September 29 conference, which the first scheduling conference of the Supreme Court's fall term. The order granting or denying cert will be published -- it may merely be a one-line order saying certiorari granted or certiorari denied -- a few days later in early October.
