Because the issue of "Birthright Citizenship" was JUST discussed in a private conference held between the members of the SCOTUS yesterday - https://www.democraticunderground.com/10143569678

They have a choice of whether to turn away 45's appeal (of 2 of the 4 cases that went against him) -OR- (from the above-linked OP's article) -

What Happens Next

The justices could decide as soon as Monday whether to hear the appeal, according to The Associated Press. If they take the case, arguments would likely be held in the spring, with a ruling expected by summer.
